The ongoing judicial review proceedings before the Bavarian Administrative Court reveal that the Bavarian state government has no files on which to base its decisions on Markus Söder's massive restriction of fundamental rights.
The litigating Criminal lawyer Jessica Hamed of the Hessian law firm Bernhard Korn & Partner, describes the procedure in a published e-mail dated 17.8. as scandalous.
"On five pages, the Bavarian Ministry of Health explained (...) that no official file existed and could not be compiled," writes the lawyer in her statement, which I have made available for download here.
In the ongoing proceedings, according to Ms. Hamed, the Free State of Bavaria merely stated that the state government had made its decisions on the basis of "scientific studies", "press reports" and "individual discussions with virologists", without naming these specifically or documenting them in an official file.
In parallel proceedings, a Thuringian judge(!) has filed an urgent application with the Thuringian Higher Administrative Court against the obligation to wear a mask and keep your distance.
In these proceedings, the lawyer argued that 1,785,000 people in Thuringia had to wear masks to prevent a maximum of 2.8 infections per week.

So why is Mr. Söder still allowed to govern? Why does a court take so long to reach a decision in a case like this? Like everything and always, all efforts by clear-thinking lawyers, medical experts and scientists in this matter will probably come to nothing.

Wenn durch „Massnahmen“ der Regierung der Virus beseitigt würde, wäre das Ganze sinnvoll. Da aber Quarantäne oder Kontaktbeschränkungen nur eine Infektionsfolge verzögert, macht das Ganze keinen Sinn. Denn wie bei z.B. der Grippe Welle geht es regelmässig weiter mit Infektionen. Das läuft so seit Jahrhunderten !?

After reading the legal documents, I did the math again myself:

Und daraus werden Grundrechtseinschränkungen abgeleitet?

I have just listened to the interview with Prof. Hockertz and would like to thank you for this important contribution. But contributions like this one or many other critical voices are defamed and portrayed as lacking solidarity.
I no longer feel like I live in a democratic country. Life at the moment is just sad. Our family and circles of friends are becoming divided. Our children have to wear nonsensical face masks to school and childcare.
I am an intensive care nurse and have to put up with this despite knowing better. In January I only worked with a face mask myself, but I quickly realized that this was only due to scaremongering. By March, it was clear to see that the situation had been completely exaggerated and I became increasingly annoyed by the reports and political decisions. With the initial justification of preventing an overload of the healthcare system, corona measures were to take place. But there were already hardly any Covid19 patients. I have been working in a cardiac surgery intensive care unit for 18 years and we became a Covid admission ward this year. I can remember two serious cases, but they were admitted from further away and had various pre-existing conditions and were months ago. We haven't had any more Covid patients for many weeks.
However, the vast majority of doctors and hospital managers don't want to hear about this either, saying that this is due to the measures.
Prof. Bhakdi, Dr. Wodarg, Prof. Hockertz and there are so many who are trying to draw attention to this madness, but I don't believe that they will be heard and that this madness will finally come to an end. Life sucks like this.

Statt darüber zu streiten, ob es eine Ausgangssperre geben darf oder doch „nur“ ein Kontaktverbot, sollte der Gedanke von Lübbe-Wolff diskutiert werden, nämlich der, alle Menschen ab 60 oder 65 (und spezielle Risikogruppen) zu isolieren, um der deutlich größeren anderen Gruppe ein weitestgehend uneingeschränktes Leben zu ermöglichen und damit gleichsam auf den Nebeneffekt der sog. Herdenimmunität zu setzen. Ergänzend sollten auch die erfolgreichen Maßnahmen von Südkorea gegen die Verbreitung des neuartigen Coronavirus diskutiert werden. Südkorea hat mit einer erheblichen Anzahl an Testungen, der konsequenten Nachverfolgung von Ansteckungswegen und intensiver Hygienemaßnahmen (Desinfizierungen des öffentlichen Raums, mundschutztragende Bevölkerung, flächendeckende Fiebermessung usw.) die Ausbreitung des Virus in den Griff bekommen, ohne dass es zu einem shutdown gekommen ist.“

From around 60 (and special risk groups - whoever defines this on what basis), you are just ballast that robs the larger, more valuable group of their livelihood. This is sick, inhumane and the worst kind of neoliberalism. And the fact that this idea apparently comes from Lübbe-Wolf does not make it any less reprehensible. Quite the opposite. I will fight such people wherever I can.

First of all, I agree with you about bureaucratic arbitrariness. It must always be law and order and, above all, logical.
However, I sometimes take issue with the statement of proportionality.
The way I read it here, the measures should be lifted completely because they restrict human rights, among other things. But what about my own rights? The state has the task of protecting every individual from violations of their integrity by others! If the measures are lifted, it contradicts this task. (what restricts one person protects another)
I don't know if you have also been affected by losing family members in connection with covid19. But I now think differently. I would have liked to have lived a little longer with my relatives, but the virus cut this short. I'm not a doctor, virologist or anything like that, so I can only judge to a limited extent. However, I have to live with the result.

(so wie es einige Mediziner bereits bei der „schweren Grippe“ es angemahnt hatten). Es ist für unsere Politik nicht einfach den Spagat zwischen der Gesellschaft und der Wirtschaft hinzulegen, genauso wenig für das Recht jedes einzelnen, aber tauschen möchte ich auch nicht mit denen. Denn besser kann ich es bestimmt nicht.

I'm drunk myself and have been following the madness in the mainstream and social media for months, taking part in demonstrations, was also a so-called Covididiot in Berlin on August 1st and now have health problems. My mother has dementia and has been in a care home since February. During her last visit, an incident occurred in which the people in charge of the home behaved in such an inhumane and antisocial manner. When we entered the facility, my sister and I were wearing masks, but our mother approached my sister without a mask and hugged her. My sister allowed the hug and the nursing staff reacted hysterically and tried to separate the two of them. After my mother and sister didn't respond immediately, the head of the home was called in straight away. A discussion then began and we were told that if we didn't comply with the measures prescribed by the authorities, we would be banned from visiting. I then contacted the responsible district authority in writing and asked them to tell me why our district in Bavaria has different regulations regarding coronavirus measures in care homes. I then received the answer from the authority that we should have a clarifying discussion with the employees of the home and if our mother does not tolerate wearing mouth and nose protection, we must have the home management give us a protective suit with gown, gloves and an FFP2 mask without an exhalation valve and wear it. I will no longer stand by and watch what is currently happening in our society and will use my opportunities to draw the public's attention to the abuses. I sincerely thank all those who are committed to trying to stop this injustice. You speak from my soul!

Es ging dieser Regierung noch nie um das Wohl und die Gesundheit der Bürger, es ging immer nur um das System! Das Gesundheitssystem sollte nicht zusammenbrechen (was auch -ohne Lockdown- nie passiert wäre!) – so wurde es auch von Anfang an kommuniziert. Ich hab durchaus damals zwischen den Zeilen gelesen. Es ist unerträglich, für wie dumm die Bevölkerung gehalten wird. Sicher gibt es viele „Schläfer“ und „Mitläufer, weil die sich von der absichtlich geschürten Angst manipulieren lassen! Falls diese Regierung jemals überhaupt im Interesse der Gesundheit der Bürger handelte, so hat sie diesen WEg bereits schon lange verlassen – denn sie haben noch nicht mal den Mut, ihre Fehlentscheidungen zuzugeben. Aber von einer starken, volksnahen Regierung erwarte ich, dass sie zu ihren Fehlern steht. Und dann einen neuen Weg beschreitet. Doch diese Regierung besteht letztendlich nur aus Marionetten, die den großen Wirtschaftsunternehmen und den Lobbys hörig sind … Wie sagte Churchill: glaube keiner Statistik, die du nicht selbst gefälscht hast.
